Consumer Protection Laws

Since the establishment of the first timeshare facility in 1974, more than 9 million individuals have purchased timeshares with the belief that they were investing in real estate. However, timeshare owners have now come to realize that their supposed "vacation property" is actually a financial burden, as selling the timeshare proves to be nearly impossible, and the resale and transfer market is exceptionally challenging and unprofitable.

 

Salespeople have been dishonestly selling timeshares, thereby violating the Federal Trade Commission's Unfair and Deceptive Trade Practice Act (15 U.S.C.A. § 45(a)(1)). This statute explicitly declares that any "unfair methods of competition in or affecting commerce, and unfair or deceptive acts or practices in or affecting commerce" are illegal.

 

The Federal Statute, along with State consumer protection statutes that mirror it, may have been violated by timeshare developers and their agents. An attorney who specializes in Consumer Protection/Rights Law will be engaged to exercise the right to redress and receive a fair settlement for valid claims, which may include compensation for misrepresentation, substandard products, or unsatisfactory services.
